I'm guessing the prosecutors and police have a good idea of what they're doing. I'm sure there is more to the story than Wolcott simply punching a guy during a mutual fight. Maybe there was a problem inside the club? Maybe Walcott left, "laid in wait" and then attacked the other guy from behind, knocking him out. Then maybe he stomped him while he was unconscious. I don't know the details, no one seems to have made any attempt to find out, but you can't be charged with first degree murder without having the intent, or premeditation of killing someone.

For a murder charge to exist, or the attempt to commit that crime, the state will need to show premeditation and intent to kill. There is much more to this story.

I read the law on endangering an injured victim and it would have nothing to do with beating him while he was unconscious. It basically says that if you knock someone out or cause them to become mentally incapacitated that they (Wolcott in this case) must recognize that and attempt to get him medical treatment. Because Walcott left the scene and made no attempt to get the victim help, then he basically left the victim there to die. Which is what that crime is. If Walcott knew that someone else called 911 to get the victim medical assistance, then Walcott would not be charged. We have no idea if there were witnesses, if Walcott knew there were witnesses, if this was recorded on security footage from the club, so we don't know much about Walcott's mindset.

Based on the charges and the condition of the victim (currently in a coma and having a good chance of dying) is sounds like a pretty brutal attack. Not your typical misleading headline reported by the news.
